An Uber accident claim in Virginia is an injury claim arising from a crash involving a driver working on the Uber platform, whether you were the rider, another motorist, a pedestrian or the Uber driver. What the Uber app records, and how to keep it
Riders hold part of the proof on their own phones. In the Uber app, past rides are listed under the Activity tab, and each trip carries a receipt with the driver’s first name, the vehicle, the pickup and drop-off points, the route map and the times. Take screenshots of that trip the same day and save the emailed receipt.
- Trip receipt and route map. They tie the driver and car to a time and place.
- Safety features. Uber’s app includes a Safety Toolkit and a crash detection feature that can prompt riders and drivers after a sudden stop. Any prompt or report you made is part of the record.
- Messages with the driver sent through the app before or after the ride.
- Driver-side data that only Uber holds: whether the driver was online, on a trip or between trips, plus GPS and speed data. We request that it be preserved.
If the crash was reported in the app, you will typically hear from an insurance representative rather than from Uber itself. Do not sign a release or give a recorded statement before an attorney reviews the claim.
Uber rides versus Uber Eats deliveries
Many Uber drivers also accept Uber Eats orders, sometimes back to back on the same shift. A driver carrying a meal is not carrying a passenger, and the insurance picture during a delivery can differ from the passenger coverage described in Va. Code § 46.2-2099.52. Drivers who are hit, and people hit by them, need to know which kind of trip was active.
That question is answered by Uber’s records, not by what the driver says at the roadside. We ask for the trip log for the minutes before and after the crash. If the driver was delivering food, the claim looks more like a delivery driver accident and we build it that way.
Does the Uber ride type matter?
Riders in Northern Virginia choose among several Uber options: UberX, UberXL for groups, Comfort, Black and scheduled Uber Reserve trips, which are popular for early flights out of Dulles and Reagan National. For most options, the driver is using a personal car under the rideshare coverage rules.
Premium black car trips can involve drivers who operate as licensed commercial carriers with their own insurance arrangements. When the car was a black car or SUV, we confirm the operator’s licensing and insurance before assuming which policy applies. It adds a step but it avoids chasing the wrong carrier.

Passengers are in the strongest position because they were not driving. If another car caused the crash, the other driver’s insurer is primary, and the rideshare coverage stays in the background if that driver is uninsured or underinsured.

Other drivers, pedestrians and cyclists face Virginia’s contributory negligence rule, which generally bars recovery by a person found even slightly at fault. In those cases, early scene evidence, including business cameras around Tysons, Clarendon and George Mason University where Uber traffic is heavy, often decides the case.

Uber treats drivers as independent contractors. A driver hit by someone else usually claims against the at-fault driver, and uninsured and underinsured motorist coverage matters when that driver cannot pay. Mistakes that weaken an Uber claim
- Waiting for Uber to call. A report in the app does not open a full injury claim or preserve the driver-side data.
- Skipping the police report because the driver asks you to handle it through the app.
- Leaving the scene without the Uber driver’s personal insurance details.
- Accepting a ride credit or small payment and signing a release that ends the claim.
- Delaying medical care, which lets the insurer argue the injuries came from something else.
Uber’s terms of use include an arbitration agreement that can affect claims against the company itself. It does not usually control a claim paid by the required insurance, but we review it in every case.
How long you have after an Uber crash
Virginia generally allows two years from the date of injury to file suit, under Va. Code § 8.01-243(A). Trip data and camera footage disappear much sooner, so start a free case review and let us send preservation requests while the records still exist.
